On the Right Claiming of the Disadvantaged in Social Transition Period

转型期的弱势群体,主要是由于社会权利和义务关系结构的重新调整而形成的。自由和平等权是其权利表达的道义理据和法律理据,生存权、就业权、政治参与权、受教育权是其权利表达的内容。权利表达的途径可以分为直接表达途径和间接表达途径。当前权利表达的制度性安排有诸多缺陷,必须从观念层面进行突破,操作层面进行完善。

The disadvantaged in the social transitional period are the fallout in reconstructing and readjusting the social right and obligation. Freedom and equality are the legal base and moral ground of their rights; the rights to subsistence, employment, political participation, and education are the main content. The channel to claim the right could be divided into two： direct and indirect. There exist many faults in the current right--claiming mechanism, so it is necessary to first make breakthroughs in our theoretical thought pattern, and then make improvements in the right--caliming implementation.
