论个人在国际环境法中的主体资格

On the Statue of Individual as the Subject of International Environmental Law

国际法的实践发展逐渐动摇了传统的国际法主体理论,学术界越来越多的人开始承认个人的国际法主体资格。国际环境法作为现代国际法的新领域,个人在此领域的地位如何有待于重新认识。从阐述国际法主体理论的新发展入手,在分析国际环境法涵义及其构成要件的基础上提出个人实质上已具备国际环境法的主体资格,并进一步从已然性与应然性两个方面来论证笔者的观点。

The practical development of international law gradually challenges the traditional subject theory of international law. Researchers admit that the individual should be the subject of international law. Since Enviromental law is a new branch of international law, we should have new insights on the statue of individual in this new field. Firstly,the article describes the new development of international law about the subject theory. The writer expounds that the individual should be the subject of environmentlal law, considering the definition and the essential elements as the subjecct of environmental law. Lastly the writer gives a deeper explantation of this view.
