The Ethical Explanation of the Rule of Law——The Ethical Thinking on the Contemporary Construction of Rule-of-law of China

建立现代法治国家是我国现代化建设的重要内容,也是我国法制建设的理想目标,然而法治不是一个完全抽象的、脱离社会现实或游离于人们日常生活之外的秩序,而必须存在于人们的伦理生活之中。人们的伦理意识和价值观念是支撑法治国家的精神内核。所以,在我国现代化建设进程中,与现代社会要求相适应的法律制度建设和伦理意识的培养都是不可缺少的;在建立现代法治的过程中绝不能忽视其固有的深层的精神意蕴——伦理性,这也是建设高度文明的和谐社会的本质要义之一。

To establish a modern state of the rule of law is the important content of the construction of modernization of our country and the ideal goal of the legal system construction, but the rule of law is not the abstract order being separated from the social practice or people＇s everyday life, it must be set in the people＇s ethical life. People＇s ethical awareness and values is the spiritual crux that set up the state of the rule of law. Therefore, to cultivate people＇s ethical awareness is as necessary as to construct the legal system that meet with the modern society during the course of the modernization construction, and so, when trying to set up a state of the rule of law, we can＇t neglect the innate spiritual meaning existed deeply——the nature of ethics which is the fundamental content of the harmony society.
