摘要
在终结劳动争议处理的方式中,协商、调解是容易被忽视的手段,其地位和作用并未引起理论和实务界的广泛重视。除了协商、调解的制度设计本身在实践操作中存在着诸多不切可行之处外,究其根本原因在于现行法律、法规对协商、调解过程中所达成的协议的功能定位有误,给劳动争议的处理带来了巨大的阻力和不便。因此,有必要通过对劳动争议协商、调解过程中所达成的和解协议、调解协议的效力及其功能问题进行深入剖析,肯定其在劳动争议处理中所具有的重要意义。
In the means of settling labor disputes, consultation and mediation are the ways that are easily neglected. The academic and practice world haven' t paid due attention to their status and function. Besides the unfeasible places in the practical operation, the main reason is that the current law and regulation don ' t give accurate function status for the agreement achieved in the consultation and mediation. As a result, it brings great resistance and inconvenience to the labor dispute settlement. Therefore, it is necessary to analyze the effect and function of the setdement agreement and mediation agreement in the labor dispute setdement, and make sure its importance in the labor dispute setdement.
