摘要
以《中华人民共和国物权法》的立法进程作为中国渐进式制度变迁的一个案例,本文从中国农耕社会的习俗、双重制度规则、传统价值观念和放任的小农经济等方面剖析我国制度变迁渐进性特征背后的历史文化背景,从制度与文化的渊源关系出发,论证了正式制度变迁受到的惯例、习俗和价值观念这些非正式制度限制,从一个新的角度解释了不同国度和民族制度的差异性。
Taking legislative process of Property Rights Law in People＇s Republic of China as an example of China＇s gradual institutional change, this paper analyses the historical and cultural backgrounds of the China＇s gradual institutional change from custom of rural society, dual rules, traditional value-view and laissez-faire peasantry economy. At the same time, based on the relationship between institution and culture, it proves informal institutions such as habit, custom and value-view restrict the formal institutional change. As a result of that, it interprets the divergence on institution between different nations.
