现行公益建设征地补偿制度下的产权缺失与效率损失分析

摘要 国家公益建设征地属于土地产权变动。从产权变动角度分析,公益建设征地是国家土地市场控制权而不是政府的超经济特权,承担土地公益职能的义务主体是国家而不是被征地的农民,公益征地补偿价格应当高于而不是低于市场价格;从效率视角分析,现行征地补偿价格低于基于市场机制形成的公平价格,既是造成农民土地权益流失的原因,又是公益建设征地浪费的根源。 The levied national land for commonweal construction is a kind of alternation of land property right. From the viewpoint of property right, the levied land for commonweal construction is the control power of national land market, the extra - economical privilege of the government. It is the government rather than the farmers whose land are levied, which undertakes the duty of upholding public good. So the compensation price of the levied land should be higher than the market price. From the viewpoint of efficiency, the current compensation price , lower than the fair market price, causes the loss of the farmers' land benefit and the waste of levied land for commonweal construction. Therefore, the paper suggests that the levied land for public construction be fairly compensated.
