论“法制”向“法治”的过渡

On the transition from legal system to the legal management in China

在中国的法治语境下,由"法制"向"法治"过渡具有现实必要性。然而,由于经济发展、公民法律意识、法律法规及其运行机制等方面的因素,在现实中国法治语境中由"法制"向"法治"的过渡还面临困难,需要采取切实有效的措施来实现"法制"向"法治"的过渡,以推动中国法治国家建设的进程。

Under China＇s legal management environment, the transition from legal system to legal management in China is really necessary. Because of the factors such as economic development, legal consciousness of the Chinese citizens, laws and regulations and their implementing mechanism, and so on, in current China＇s legal environment, the transition from legal system to legal management faces the difficulties, as a result, real effective measures must be used to realize the transition from legal system to legal management so as to promote the progress of China＇s legally-managed country construction.
