The Study on AFTA Competition Policy

一、东盟自由贸易区竞争政策提出的背景 1992年在新加坡召开的东盟第四次首脑会议上，东盟各国签订了《新加坡宣言》和《东盟加强经济合作的框架协定》，宣布从1993年1月1日起15年内（即2008年之前）建成东盟自由贸易区（AFTA），将区域内的关税降至0％-5％，基本实现成员国之间免除关税，并通过了《东盟自由贸易区共同有效普惠关税安排协定》，这标志着东盟自由贸易区计划的正式出台。虽然东盟自由贸易区计划的主要目标是在关税削减方面的合作，但其也寻求其他领域的合作，其中就包括公平竞争规则的推行。

Since its foundation, AFTA had promulgated many multi-lateral agreements, like ＂Agreement on the Common Effective Preferential Tariff （CEPT） Scheme for the ASEAN Free Trade Area＂, ＂ASEAN Framework Agreement on Services＂, and ＂ASEAN Framework Agreement on Intellectual Property Cooperation＂ etc, which include competition policies as well as trade policies. Since those scattered competition policies are disadvantageous to the progress of ASEAN economic integration and the settlement of competition disputes, unified competition policies in the ASEAN area become necessary. This paper illustrates the advice and status quo of AFTA competition policies and predicts the optional mode of AFTA competition policies.
