消极身份犯概念之考量

Research on the Negative Status Crime

身份犯是刑法所规定的一类"特殊"的犯罪形式,由于对犯罪主体资格的特殊要求而与一般犯罪相区别。刑法学界对身份犯的研究一般是将重点置于"身份犯之共犯"问题的研讨中,而对于身份犯自身体系的研究则鲜有论及。为弥补此一理论空缺,试图将身份犯概念的研究作为重点,以此为前提检视消极身份犯概念。

The status crime, which is different from the general crime due to the special requirement of the criminal subject, is a kind of special crime in the criminal law. The study of status crime from criminal law experts is more focus on the accomplice of status crime, and less discussion about the self-system of status crime. In order to make up for the vacancy of the theory, the author takes the conception of negative status crime as important field to study.
