网络著作权是以传统的著作权为基础,适应网络技术的发展而产生的。由于网络的开放性、技术的先进性和无国界性,致使网络环境中著作权的侵权行为屡屡发生,未经许可的转载行为、复制行为、超链行为、网上浏览等都给网络著作权人构成一定的侵害。保护网络著作权应充分利用现行法律法规并及时解释和修正;构建网络环境下著作权集体管理制度;明确网络著作权侵权赔偿标准。同时,网络著作权人还可以采取控制接触作品、控制使用作品、保证支付报酬等技术措施,从而尽可能保证网络著作权不受侵害。

Network copyright has emerged on the basis of traditional copyright to fit in with the development of network technology. The use and development of network technology have made a great impact on the copyright system. The article explains the types of the infringement of network copyright and explores network copyright protection from legislative and technological angles.
