国有土地使用权出让中代表权研究

A Study of Delegacy in Assignment of Right to Use Stated-Owned Land in Urban Areas

通过对土地使用权出让过程中,国务院、地方人民政府和土地管理部门的权利义务进行分析,明确了相互之间的关系;发现城市土地使用权出让过程中,存在着权利与义务不协调,寻租、国家所有者地位得不到完全体现,对国家利益造成损害等问题。根据当前土地使用权出让中存在的问题,提出了国有土地使用权出让过程中应当遵循的原则以及解决问题的对策和建议。

This paper analyzes the responsibility and the right among State Council, local people＇s government and land ad ministrative department in the process of assignment of the right to the use of land, discovering that the responsibility and the right among State Department, local people＇s government and land administrative department can＇t be in harmony sometimes, and that the rent and the position of the country as the owner of the land can＇t be realized totally, damaging the interest of the cotmtry. The paper sets forth the principle in the process of assignment of the right to the use of land, and proposes the way to solve these problems.
