On the Efficiency Orientation of the Economic Administrative Law

从经济分析的角度看,经济行政法应以实现资源配置的帕累托效率为导向。这是因为经济行政主体干预经济的理由在于克服市场失灵,实现资源配置的帕累托效率。但是由于存在公共失灵的问题,经济行政主体难以实现其效率的目标,需要经济行政法对经济行政权力进行控制,以便克服公共失灵的问题,因此经济行政法存在的理由在于通过控制经济行政主体的经济干预行为来促成社会资源配置的帕累托效率状态,其必然是效率导向的。

On the view of economic analysis, economic administrative law is efficiency - oriented. The reason is that government could cure＂ market failure＂ and reach Pareto efficiency in resources distribution. However, government may fail to realize the efficiency for＂govemment failure＂. Thus, economic administrative law is needed to overcome ＂government failure＂ through power control. The reason for economic administrative law to exist is to regulate the economic intervention of government to get Pareto efficiency, so economic administrative law must be efficiency-oriented.
