民族教育的发展须加大立法保障

Strengthen the Legislation Protection of National Minority Education

我国民族教育有了很大发展,但民族教育与内地特别是东部沿海相比,差距仍很大。本文通过分析研究我国民族教育发展及民族教育立法现状认为,民族地区环境恶劣、办学艰难、经费短缺、民族教育性质特殊、尤其是民族教育立法体系不健全等是民族教育不能与全国教育均衡发展的因素。提出保障和实现少数民族公平受教育的权利,需借鉴外国立法,加强民族教育立法,健全民族教育与全国教育均衡发展的法律保障机制。

Nowadays the national minorities education in China has made a rapid progress, but it still has a big difference from the educations of other areas, especially the east. Througln thc analysis of the development and legislation situation of minority nationalities education, the paper elucidate tlnat many factors including the harsh environment, difficulties of running the schools, short of fimds and special properties of nationalities education, especially the undeveloped legislation system of minority nationalities education cause the disequilibrium development between national minority education and the educafion in other areas. The paper propose that we should use the foreign legislation for reference to strengthen the legislation of national minority education and the legal protection system for equilibrium education development in China, to protect and realiz the right of minority nationalities to be educatedfairly.
