摘要
本文以日本法律文化作为契机,通过阐述比较法在理论层面、实践层面已经发挥的作用和功能,展现了比较法的力量所在。但同时,比较法也是存在弱点的,不同法律文化中种种难以统一的差异的存在使得比较法不可能逾越文化认同的界限,它的最终目的应该是追求法律的和谐而非法律的统一。
The article elaborates the functions of comparative law having developed on theory and in practice and embodies the power of the comparative law by analyzing the legal culture of Japan. Meantime, the comparative law also has its weak points： the existence of differences in various legal cultures which could not be integratey make comparative law not able to exceed the limits of various cultures. So the ultimate goal of the comparative law should seek for harmonization among different legal cultures and not seek integration.
