摘要
本文对附随义务的概念特征、功能形态、法律性质、制度价值等基本理论问题进行了探讨,并将附随义务与英美法上的默示义务进行了比较,以期对附随义务的理论研究和制度建设有所裨益。
The paper discusses some fundamental theoretical problems, such as features of the concepts of attached obligation, function and shape, law characteristics and system value, and does some comprisons of the silent obligations between Britain and America.
