论《物权法》征收条款中“公共利益”的范围

The province of public interests in the Article of requision in Real Rights law

由于诸种原因,在物权法中,关于征收条款中的"公共利益"这一重要的概念并未作出清晰的界定。对这一概念的界定将是社会各界保护自己权益或采取行动的重要依据。因此如何理解该词具有重要的理论和实践价值。借助于法理学和部门法知识可以对该概念的范围做出大致的界定。

Due to some reasons, the concept of public interests＇has not been clearly determined in the Article of requision in Real Rights law. The very important concept is the foot of all people who protect their own rights and who take some actions from it, so how to interpret the meaning of ~ublic interests＇is of great theoretical and practical value. We can give an interpretation of the province of it by using the theory of the Jurisproudance and by other legal regula- tions of segment law.
