摘要
我国已确立林业的可持续发展战略,但现行林业产权法律制度却不是以可持续经济理性为基础构建的。通过分析现行林业产权法律制度和可持续发展的矛盾成因,揭示了我国现行林业产权法律制度的问题症结,并提出根据可持续发展的要求,以林业法的制定为契机,重构我国的林业产权法律制度,从而完成林业产权制度自身的变迁和创新。
Although the sustainable development strategy has already been established,the available forestry property right legal system is not composed on the basis of sustainable economy theory.The paper analyzes causes of the contradiction between available system and sustainable development to reveal issue crux of the system in our country.According to requirements of sustainable development,forestry property right legal system is reconstructed at critical point of the formulation of Forestry Law to finish the transformation and innovation of forestry property right system itself.
