Research on Mining Contract Management System Catering to Status Quo of China

探索一个适合我国国情的矿业合同管理制度,是在市场经济条件下,综合运用经济、法律和必要的行政手段加强矿业权管理的体现,也是对我国当前矿业管理制度改革创新的一个有益尝试。通过对国外矿业合同管理法律制度进行比较研究,文章根据我国矿业管理和法治实践的时代需要,从矿业合同的法律依据、合同主体、合同形式、违约的处理、合同内容等几个方面,对适合我国国情的矿业合同管理制度进行了探索。

Seeking for mining contract management system that caters to status quo of China represents more enhanced management of mining rights through combined economic,legal and administrative means.Meanwhile,it's also a tentative study in innovation of the current system.The paper makes comparison between foreign and domestic mining management systems,and probes into the appropriate system for China from aspects of legal basis,contract subject,contract formation,default punishment,contract content,etc.
