摘要
同时履行抗辩权是基于双务合同的牵连性理论而构造其理论基础,其产生和发挥作用是基于双务合同的目的和本旨。同时履行抗辩权的功能更多的是保护权利人自己的现有利益避免可以预见的损失。作为一种抗辩的权利,属于一时的抗辩。
Meanwhile performance defense is based on the theory of involvement in the mutual obligations contract. The origin and the role it plays are based on the cause of the mutual contract. The function of it mostly consists of protecting right keeper in avoiding losing his lose unexpected. As a kind of defensive right, it belongs to the contemporary defense.
