On the Dilemma of Constitution in Modern China

极具现代性和社会认同度的立宪政治却在近代中国遭遇了以失败而告终的结局,近代中国宪政的困境在于:一是在西方挑战的持续冲击和民族危机的强大压力下,中国政治必须"全变"的激进主义选择;二是宪政诉求的工具主义倾向,而忽略了宪政本身所蕴藏的价值及其生长的支持性条件;三是近代中国国家权威和市民社会的双重贫困阻碍了宪政的建立和法治的实现。

The constitutional system in modern China which bears the characteristics of modernity and social identity ends in failure.The dilemma of constitution in modern China can be shown in three aspects—the choice of radicalism for political reform under the great pressure of national crisis and challenges from western countries,the instrumentalism tendency of the constitutional pursuit which results in the overlook of the constitution value and condition,and the poverty of the national authority and citizen society in modern China which hinders the establishment of constitution and the realization of the government by law.
