摘要
在监护人责任中,适用公平责任是为了弥补过错责任与无过错责任原则的不足,以实现法律的公平正义之价值。但是公平责任在监护人责任中的适用并不能带来公平的效果,在追求公平的同时会产生新的不公平,所以在监护人责任中,不应适用公平责任,而应采用过错责任。
The application of fair obligations is to make up the insufficiency of the principle in fault liability or no fault among guardians＇obligations in order to achieve the fair and just value of laws. However,The application of fair obligations cannot bring fair results during the use of the guardians＇obligation. On the contrary,it will produce new unfair consequences while pursuing fairness. Therefore,The application of fault liability should take the place of fair obligations in these courses.
