摘要
现代刑事法治理念在强调刑罚对社会的保护之余,更为关注刑罚对人权的保障。重刑并不必然降低犯罪的发生率,因此,轻缓刑罚观已成为当前国际刑事立法和司法领域所广为接受的新刑罚观。我国刑法对此应适当借鉴,尽快树立轻重兼顾、以轻为主的刑罚观。
The modem punishment notion requires concentration not only on the protection of the society, but also on human rights. It＇ s not inevitable for severity punishment to low the crime. Lighter punishment should be the popular view of punishment in the world.
