"最低消费"条款是否具有合理性,在理论界一直存有争议。分析"最低消费"形成行业习惯规范的社会经济原因以及假设该条款违法可能产生的负面效果,可以得出"最低消费"条款具有合理性的结论。因此,应在消除经营者和消费者的认识误区、确立"容忍合理损害义务"的基础上,让市场对"最低消费"现象进行自主调节。

Dispute of the rationality of“the lowest consumption” always exists. After the form legalization of this standard term, the content whether breaches the legal compulsory standardization is still an important problem. Some explanations of the rationality could be demonstrated when analyzing the social background of the trade practice and economical consequence if this term is illegal. If we acknowledge correctly the difference of operator and consumer and take use of the “the obligation of tolerance for reasonable damage”, the fundamental explanation of this problem should be back to the basic principle of market economy self-directed adjustability.
