关于完善中国与东盟各国刑事司法协助立法的几点思考

Reflection of Improving Criminal Judicial Assist in China and ASEAN

中国与东盟各国开展刑事司法协助存在着许多空白或重大不足。一方面,中国立法的某些缺失无法对双方的刑事司法协助给予强有力的国内法律支持,以致于双方在协助中产生矛盾与不协调;另一方面,中国与东盟国家已有的刑事司法协助条约中,其协助形式大多比较单一,无法满足现实需要,增加一些新型的协助形式应为当务之急。同时,中国应加快与东盟各国刑事司法协助条约的签订与完善工作。

The criminal judicial assist in China and ASEAN is not enough. On one hand, the legislation of China is unable to support the team up with ASEAN, so that the problems come into being. On the other hand, most of assist form is simplistic that unable to satisfy with present, increasing some new type assist is too impatient to wait. At the same time, China should sign and perfect the treaty with ASEAN at once.
