法国半总统制半议会制的政体模式、政党制度、双重司法体系和宪法委员会等制度特点,使得法国政党政治因素可以通过在总统大选胜利后,由总统通过法官的人事任命权影响司法,也可通过行政法院的特殊设置和宪法法院同时具有的政治、行政、司法职能影响司法审判。而中国的历史文化传统、政体特点、党委政法委和审判委员会的设置使得中法两国政党政治因素影响司法的方式、程度不尽相同,可以通过对法国与中国的司法审判中政党政治因素的客观比较分析得到一些启发。
