台湾地区《组织犯罪防制条例》及其借鉴

Introduction to the Anti-Gangsterism Ordinance of Talwan and Its Referential Value

我国台湾地区关于惩治黑道犯罪的法律依据主要有台湾地区刑法第154条、《检肃流氓条例》和《组织犯罪防制条例》。《组织犯罪防制条例》系在前两者基础上修订而成,对组织犯罪的定义、处罚量刑以及特殊的证据制度和诉讼程序等方面作了比较完善的的规定,对我国大陆地区增设特别的证据制度和刑罚制度,制定惩治黑恶势力犯罪的专项立法,提高"打黑除恶"斗争的实效可资借鉴。

Laws of Taiwan region against the gangs＇crime mainly include Criminal Law No. 154, Anti-Rascal Ordinance, and Anti-Gangsterism Ordinance. The Anti-Gangsterism Ordinance, enacted based on the former regulations, well provided the definition, punishment, special rules of evidence and procedure of the organized crime, which will be referential for the effect of striking the organized crime in Chinese mainland by amending special provisions and enacting specific law.
