我国土地征收立法之反思与重构

Review and Reconstruction of Our Land Expropriation Legislation

我国土地征收的立法规制主要体现在《宪法》、《土地管理法》和《物权法》对土地征收法定要件有相应的规定;我国土地征收立法在立法模式和征收要件的规定上存在缺陷,尚需反思;我国土地征收立法之重构既应采集中型立法模式,又必须完善土地征收的法定要件。

Our land expropriation legislation rules and regulations mainly manifest themselves as corresponding stipulations on legal essentials of land expropriation in ＂Constitution＂, ＂Land Administration Law＂ and ＂Real Right Law＂. Since the land expropriation legislation has deficiencies on stipulations of legislative pattern and of expropriation essentials, deliberation should be given to it. Therefore, restructuring the land expropriation legislation requires both adoption of the centralized legislative pattern,and perfection of legal essentials of the land expropriation.
