宪法司法化:公民基本权利保障的路径

Constitution Judicialized: Another Way to Protect the Citizens' Basic Rights

由于宪法本身具有高度的抽象性,法官缺少运用宪法的知识和理念,人们对宪法属性认识不够以及司法实务界对相关司法解释存在认识上的偏差等原因,导致我国宪法存在严重的"虚置"问题,公民基本权利也难以保障,这样宪法司法化就势在必行。可喜的是,现有的国际成功经验可借鉴,国内的初步实践也可总结。司法机关可以通过宪法解释权、宪法监督司法化等措施实现宪法司法化,从而更好地保障公民的基本权利。

The abstraction of the Constitution makes it hard for people to have a good command of its natures. Besides, some judges lack knowledge and correct ideology in putting the stipulations in the Constitution into practice. Furthermore, the judicial circles sometimes make inexact explanation of the Constitution. All these lead to the problem of ＂constitution nominalized＂ and citizens＇ basic rights cannot be well protected. Constitution judicialized is necessary and practical in view of the successful experience in other countries. Judicial organs may realize constitution judicialized by way of using the right of constitution explanation and making constitution supervision judicialiezd so as to protect citizens＇ rights well.
