完善我国矿业法律体系的思考

Thought on Perfection of Chinas Mining Legal System

20年来中国在矿业领域的法制构架取得了巨大进步,但问题也日益显现。从分析矿法体系在实践中存在的问题入手,提出我国矿业资源法律的全面修改完善已经刻不容缓。在具体措施上,认为要在矿业资源权属体系、矿业权制度、税费改革和民事法律救济途径4方面加以完善,应建立健全明晰的矿产资源权属法律体系,提出要在新的矿业法律体系中赋予矿业权明确的准物权性质,注重矿业权平等,完善矿业权的取得和流转制度等需要完善的方向。希望对我国矿法体系的完善有所裨益。

Great progress has been achieved in the legal structures in China＇s mining field in the past 20 years and however, the problems have also become evident. Starting from the practically existing problems in the mining legal system, it is pointed out that whole modification and perfection of China laws concerning mineral resource have no time to delay. Specifically, perfection should be made in four aspects, namely the right ownership system of mineral resource, mining right system, tax-fee reform and way of civil legal remedy. A sound and clear right ownership legal system of mining resource should be established. It is proposed to clearly specify the quasi-property nature of mining right, pay attention to mining right equity, perfect the acquisition and circulation system of mining right. It is hoped that it sould be some help to the perfection of China＇s mining legal system.
