农村土地承包中“出嫁女”权益保障法律问题探讨

Reflections on the Law to Protect Marriage-moving Women's Rights to Land

男女平等是我国的基本国策,从中央到地方政府一直都非常重视农村妇女的权益保障问题。但在农村土地承包中,侵害农村妇女,尤其是"出嫁女"权益的情况时有发生。分析了"出嫁女"权益被侵害的表现及原因,提出处理"出嫁女"权益纠纷案件应遵循的原则,并从立法、行政和司法三个方面对"出嫁女"权益保障问题进行了探讨。

Equality between men and women is a basic policy in China. Rural women＇ s right to land is a very important question for rural society＇ s stability and development. The government has published a series of laws and policies to protect it. However, the laws and policies are poorly carried out and rural women＇s right to land has been severely undermined. Through analyzing the law and the rural customs, this article put forwards some principles to handle marriagemoving Women＇s civil dispute case. It must be supervised and restricted by legislative administration and jurisdiction.
