摘要
本文分析了侵权法过错责任危机的三个层次,讨论了过错责任、无过错责任、公平责任的基础与现代侵权法归责体系的逻辑,指出正义与和谐正是侵权法的当代使命。
Justice and harmony is the value of modem trot law.This can be found by studying the three aspects of crisis of the liability of fault,the respective foundations of the liability principles and their coherent logic.
