On The Theory of Balancing of Interests in Harmonious Legislation

和谐社会只能建立在法治基础上,和谐立法是法治社会的立法追求,是实现社会和谐的基础和保障。在现代社会中,随着社会利益结构的变迁,多元利益共生于同一场域共同争夺着稀缺的资源,面对利益冲突,现代立法的利益调控功能日显重要。和谐立法其实质是一个利益识别、利益选择、利益整合的交涉过程,当代我国和谐立法中的利益衡量应当依据一定的标准和原则。

Harmonious society can only build on ruling a basis by law.Harmonious legislation have the very important effect to realizing society harmoniously.In the modem society,with the changes of the social interests structure, plural interests are grown and fought for rare resources in the same land together,in the face of the interests conflict,it is important that the function of interests regulation and control of the modern legislation shows on day.The essence of harmonious legislation is an negotiation process of the qualification,choice and integration of interests.h should be according to certain standard and principle in modem legislative process.
