促进文化传播和经济利益平衡——民间文学艺术保护的新思路

On the Balance of Interests and the Promotion of Culture Spread as to the Protection of Folklore

作为传统知识的重要组成部分,民间文学艺术日益成为知识产权领域的热点,尽管发展中国家想积极通过法律手段保护民间文学艺术,但是并没有得到世界上大多数发达国家的认同,民间文学艺术的国际保护陷入困境。本文试从经济利益平衡和文化传播的视角探讨如何协调各国利益,找到一条兼顾各方利益的保护方案。

As a major part of traditional knowledge, folklore is becoming an important issue within the intellectual property field. Many developing countries acdvely protect folklore by legislation, which, however, has not gained the recognition of most developed countries. This article suggests building a new international system to protect folklore on the basis of balancing the interests of different countries and promoting culture spread to build a program giving attentions to every country＇s interests.
