Research on the Four Questions about Beijing Olympic Games Arbitration

北京奥运会期间,国际体育仲裁院要在北京设立一个特别仲裁机构。中国有关体育仲裁立法的缺失不会影响奥运会仲裁的顺利进行,而且,北京奥运会特别仲裁机构可以受理当事人就不服中国奥委会等组织做出的裁决的上诉。由于中国对《承认和执行外国仲裁裁决的纽约公约》的保留,在中国申请承认与执行奥运会仲裁裁决会遇到法律上的麻烦。中国应制定体育仲裁立法并对《承认和执行外国仲裁裁决的纽约公约》提出的保留进行重新审查。

During the Beijing Olympic Games,CAS will establish an ad hoc division in Beijing. The absence of Chinese sports arbitration legislation will not prevent the formal operation of Beijing Olympic Games arbitration and Chinese parties should have the right to challenge Chinese Olympic Committee＇s Olympic-related resolution and appeal them to CAS ad hoc division.Because China made reservation to New York Convention,so there will be some problems as to the recognition and enforcement of CAS awards in China.China should make its own sports arbitration act and reconsider the reservation to New York Convention.
