TRIPS协议中的地理标志问题探析——兼论我国在该问题上的谈判立场

TRIPS没有完全解决不同国家关于地理标志保护问题的矛盾。该问题的解决取决于TRIPS协议本身的要求、保护新兴知识产权的需要和两大利益集团立场上的磨合。在完善地理标志法律保护的TRIPS谈判中,我国应结合现实,从本国利益出发。在地理标志的多边注册机制问题上我国应采取既不鲜明支持也不明确反对的折衷态度,但在地理标志产品范围等问题上,我国应明确支持扩大地理标志适用对象,以发挥我国在此方面的相对优势。

Antinomy on geography indicaltions in TRIPS among different nations hasn＇t completely be solved. The result is decided by TRIPS itself and demand of protecting the newly intelligent property right and moderation of two interest groups.In negotiation of TRIPS on perfeeting legal geography indicaltions protection,we should consider our national benefits and situation .To multilateral registration mechanism on geography indications,we should not clearly support or oppose But to the scope of geography indications. we should definitely support the opmion of extending geography in dications be applied to develop comparative advantages of our nation.
