On the base of analyzing the current legislation, comparing the scholar＇s opinions and learning the foreign experiences, the paper puts forward the legislative proposal according to Chinese condition, around the scope of lawful heir, inheritance order of the spouse, the inheritance right of widowed daughters- in-law and sons- in- law and so on.
