关于循环经济立法中生产者责任延伸制度的探究

Meditation on the System of Producers' Extending Duty in Circular Economy Law

随着经济发展和环境的恶化,循环经济立法成为国家迫在眉睫的任务,生产者责任延伸制度是其中关键的一环。文章从循环经济和生产者责任延伸制度的理论出发,从生产者、销售者和消费者三个角度入手,对《循环经济法草案(征求意见稿)》中有关生产者责任延伸制度立法进行评价并做出具体化的建议,同时提出补充意见。

With the development of economy and the depravation of environment, the building of Circular Economy Law has become a pressing duty in China. The draft of Circular Economy Law came out in December,2005, and has attracted great attention with its system of producer＇s extending duty. This article will make a comment on the system of producer＇s extending duty in the draft of Circular Economy Law based on the theory of circular economy, and then put forth some suggestions.
