Competition Policy and Trade Policy

尽管竞争政策与贸易政策紧密相关,但传统上还把它们视为不同的领域。当世界贸易大量增长,跨国投资快速增加,多国性企业逐渐在国际经济活动中扮演重要角色之后,贸易法和竞争法传统上互不跨越之界限早已不复存在。从20世纪90年代起,竞争领域的国际调整开始引起人们的关注。国际社会日益认识到,私人反竞争行为与公权力施加的贸易壁垒一起成为阻碍贸易自由化的两大障碍。对于涉及国际贸易的限制竞争行为,竞争政策与贸易政策的反应不尽相同。因此,探讨竞争政策与贸易政策的不同规制路径以及二者间的平衡与协调具有一定的现实意义。

Competition policy and trade policy are traditionally regarded as different domains although they are closely related to each other. Presently, the global trade massively growths, and the multinational enterprises gradually play an important role in international economic activities. Thus the adjustment of international competition greatly attract people＇s attention. The world is aware of that private anti - competitive practices together with trade barriers imposed by the authority, become the two major obstacles impeding the trade liberalization. Therefore, the discussion of different rules produced by competition policy and trade policy as well as balance and coordination between them, no doubt has certain practical significance.
