摘要
我国的职工持股制度源于20世纪80年代初国有企业的股份制试点,在20世纪80年代中后期伴随国有企业的股份制改造而逐步得以规范发展。但目前职工持股制度存在诸如把职工持股制度筹措资金与国企改制的价值目标片面化,缺乏系统的制度设计方案,制度实施的监管不力等问题,建议立法完善我国职工持股制度时应注意体现职工持股制度的多元价值目标,注重职工持股制度整体设计,强化法律责任。
China's staff stock system, which was started in the early 1980s when the stock system in state-run enterprises was initiated, and had a steady development all through the first decade, is now defected by the compulsory buying of stocks imposed upon the staff and a lack of legal constrictions. Therefore it is time that a new system that may guarantee the interests of the staff stockholders got established.
