试论证券犯罪的犯罪形态

On Criminal Patterns of Securities Crimes

证券犯罪的犯罪形态,是指在证券犯罪过程中,由于某种原因所呈现出的静止状态。刑法所规定的犯罪形态包括犯罪的预备、未遂、中止与既遂形态。在证券犯罪的过程中,由于我国刑法对大多数构成证券犯罪的行为均要求具备情节严重或者数额巨大或者造成严重后果的才是犯罪,对于这类犯罪,行为首先是违反证券法律法规的行为,一旦实施这样的禁止性行为就会受到相关法律法规所规定的相应的处罚。所以,在这类证券犯罪中不应包括犯罪的预备、未遂、中止形态。

The criminal pattems of secutites crimes mean that,due to some reasons,the acts remain sill in the process of commiting security erines,Aeeording to the Crintinal Law of China,erimnal patterns include pattms of preparation,unaccomplised and discontinud,However,According to the erinnial law of China,most of the acts which constitute securities shall have the conditiions such as partieularly serious circumstamces,huge amount,and grat consequential damages,This paper discusses that since these kind illegal acts have violated the securities laws or regulations,once these forbidden acts happen,they be punished accordingly,Therefore,seeurities crimes have no pattens of preparation,unaceomplished or discontinued.
