摘要
同其他高科技一样,代孕技术也是一把双刃剑,在造福人类的同时,也带来了一系列法律、伦理等问题。从代孕、代孕合同的概念、特征入手,分析了代孕的几种类型,以及其是否有违民法的一般原理和公序良俗原则,进而阐明了代孕合同的标的,分情况论述了代孕合同所生子女的亲权归属,最后得出应分情况对待代孕合同的结论。
Like other high technology,pregnancy technology is a double-edged sword.It can bring mankind benefits,but at the same time it also leads to a series of legal,moral,ethical and other issues.This paper analyses the concept,characteristic and types of pregnancy contracts firstly,and then analyses whether it disobeys the principle of public order and good custom or not.And thirdly,it clarifies the subject of pregnancy contract,describes the parental authority ascription of children born from a pregnancy contract.Finally it comes to the conclusion that we should treat pregnancy contracts respectively.
