论我国近代法律翻译的几个时期

A Tentative Study on Several Phases of Legal Translation in Late Qing Dynasty

本文从翻译史的角度,就鸦片战争至五四运动这一历史时期,对我国西方法律、法学的译介进行了梳理和介绍,并在各学者研究的基础上,以时间为序(考虑到法律翻译的特点,鸦片战争以前的内容亦略有涉及),比较详细地论述了我国近代法律翻译的几个时期,即近代法律翻译的肇始,洋务运动时期的法律翻译,以及变法修律时期的法律翻译。此外,对几位有影响的法律翻译者、近代法律(学)翻译对法制近代化、译学发展的影响也有涉及。

The paper attempts to analyze the different phases of Chinese legal translation on laws and legal doctrinal writings of western countries from the perspective of translation history. The paper, based on the researches of some famous scholars, divides the legal translation history of late Qing Dynasty into three phases, namely the beginning phase, the phase of Westernization Movement, and the phase of Law Reformation and Statues Amending. The impact of legal translation on the modernization of Chinese law and the study of translation is also briefly discussed in this paper.
