摘要
实际施工人违法承包工程现象在我国较为普遍,最高人民法院对此作出了司法解释。通过对实际施工人的界定,实际施工人构成要件的阐述,实际施工人承包工程的合同的效力的确定,阐述了实际施工人应当承担的法律责任,以及根据合同相对性原则,实际施工人应当享有的法定权利。
It is common that real constructor illegally contracts construction in our country ,the national supreme Court has made relevant judicial interpretation. By defining real constructor, elaborting requisites to constitute of real constructor and confirming engineering contractual efficacy, the paper elaborates the legal liability which real constructor should assume and the legal fight which real constructor enjoy according to relativity principle of contract.
