摘要
文章从一案例反映的问题出发,指出了司法实践中劳动争议诉讼与仲裁衔接的种种困难,分析了劳动争议诉讼与仲裁衔接难的原因。在此基础上提出,"裁审分离、各自终局"是解决劳动争议仲裁与诉讼衔接问题的有效方法。
Based on a case analyzed in this article, the author points out difficulties in linking the labor dispute lawsuit and the arbitration, analyzing the sources of such difficulties. Then the author goes on to suggest a solution, that is, a separation of arbitration and the trial with respective results.
