调研了因业主违约造成的工程停建结算争议的主要表现形式;分析"黑白合同"条款的法律效力以及"黑白合同"共存下的工程结算依据;分析措施项目在施工过程中的费用投入特点并分解了其费用构成,从而确定措施项目费用的计算方法;从法律和合同条款方面探讨了未完工程利润赔偿问题;最后运用以上研究进行了案例分析。

This paper firstly investigates the main formats of construction settlement disputes owing to cessation of work caused by the default of employers, studies the validity of the clauses and settlement warranties under Black and White Contract, figures out how to calculate measure item cost by analyzing its characteristics and constitution in the construction process, explores the compensation issues of the uncompleted work from the angle of law such as contact clauses and finally carries out a case study combined with listed studies above.
