论服装品牌淡化现象及其法律对策

摘要 探究了服装驰名商标反淡化制度的起源,概括出驰名商标他人淡化和驰名商标自我淡化理论的含义及主要内容,指出服装驰名商标淡化表现方式有弱化、丑化、退化3种方式,以及针对驰名商标淡化侵权行为的法律对策.有助于推动企业运用最新法律武器保护自己的合法权益,提高服装品牌的竞争力. The origin of the famous clothing trademark dilution system is investigated, the meaning and main content of others and self dilution theory of famous trademark are summarized. At the same time, three ways of the famous trademark dilution are pointedout, including weakness, uglification and degradation,and the legal response against the famous trademake dilution which will encourage enterprises to use the latest legal weapons to protect their legitimate rights and interests actively, and improve the competitiveness of clothing brands.
