追求自由的形式:古希腊社会契约文化探源

古希腊社会契约文化的产生是一个历史的"蛹化"过程:古希腊特有的环境孕育了古希腊的自由理念,而追求自由的个人主义意蕴最终催生了社会契约论的诞生。自由是契约的目的,契约是自由的形式。西方国家的法治内容与结构,实乃对这种契约目的与形式的反映。习惯于寻求实质正义的传统中华思维模式,应当抛开对社会契约论的"唯物"与"唯心"的争论,尝试以海纳百川的胸怀,反思契约理念中蕴涵的法治精神,着眼民主的结构与程序,建设我国的民主法制。
