国家通过土地征用或征收而使农村土地"农转非"和农村劳动力"农转非"是城市化进程中的必然产物。在此进程中,"农民土地权益"受损问题的严重性已经超过了农民负担问题。究其主要原因在于我国征地法律制度本身存在着一定的缺陷。因此,重新审视和反思我国的征地法律制度并重建农民土地权益保障制度,就显得尤为重要。
