Seeking the Harmonious State of Justice between the Majority and the Minority——An Interpretation to Modern Society's Transformation and the Constitutionalism Democratic System

随着现代社会转型的纵深发展及法制的建立和进一步完善,我们需要逐步消解社会中的"不和谐"因素。为构建"和谐社会",要求少数人利益诉求得到考虑并被认真对待,故我们开始转向宪政和法治,通过重新审视民主、宪政和"多数至上主义",剥解出一些深藏其中的问题,以求通过宪政设置一些实质性和程序性的路障,达到防止多数统治已经展现或至今仍潜伏着的流弊,寻求社会中"多数"与"少数"正义的和谐态势。

As modem society＇s transformation deepens its development and legal system gets further improved, it is necessary for us to clear up those unharmonious factors in society. In order to build a harmonious society, the minority＇s benefits need to be seriously considered, thus we turn to constitutionalism and rule of law and unbind some lurking problems by reexamining democracy, constitution and ＂majority above everything else＂. By setting up in constitution some substantial and procedural to prevent some existing or dormant abuses when the majority is in power, so as to seek the harmonious state of justice between the majority and the minority.
