摘要
就业领域内的性别歧视主要表现为工资收入歧视、就业机会歧视和职业歧视。出现这种现象的重要原因是法律制度的不完善。我国没有专门的禁止性别歧视或就业歧视的立法,现有的法律可操作性不强,对于就业中性别歧视的法律责任和法律制裁的规定存在缺陷。建议制订禁止就业中性别歧视的立法,建立强制实施此法律的行政机构,同时完善生育保险制度,以此保护妇女的平等就业权。
The gender discrimination in employment area is shown in the inequality in reward, chances for job and occupation bias. The most important reason is the imperfect legal system. There is no law for prohibiting gender discrimination and employment discrimination. The present laws are abstract and impractical, and there are defects in the provisions of legal responsibility and legal sanction. It suggests making a law for prohibiting gender discrimination in employment area and setting up an administrative unit for implementing the law, as well as improving the maternity insurance system.
